HOW TO GET A PAYMENT: If you are a Known Class Member whose information is included in the Master Spreadsheet, and you agree with the information on the Master Spreadsheet relating to your Claim, you do not have to do anything to get a payment from the settlement.

If you are not listed on the Master Spreadsheet, you must complete and submit a Claim Form online or mail a paper Claim Form to the Claims Administrator to share in the settlement. The deadline to file a claim will be no earlier than December 11, 2019, and will be updated on the website.

EXCLUDE YOURSELF: If you ask to be excluded from the settlement, you won’t be eligible to share in the benefits. But you keep any rights to sue the Defendants on your own about the same legal claims in this lawsuit. You must exclude yourself by November 27, 2019. [See Q&A for Class, Question 11 here]

OBJECT TO THE SETTLEMENT: Write to the Court explaining why you have an objection to the settlement. You must object to the settlement by November 27, 2019. [See Q&A for Class, Question 11 here]

*Failure to submit a claim form, product ID, and supporting documentation by DATE TBD will result in your claim being waived.

Plaintiffs That DO NOT Qualify

Plaintiffs on this list who previously entered into a separate settlement with

  • Taishan and/or the Released Parties,
  • Mitchell Plaintiffs (Homebuilders),
  • Plaintiffs who asserted Claims against Taishan and/or the Released Parties, but whose Claims were dismissed by the MDL Court, the Florida Courts, and/or the Virginia Courts

The Settlement is intended to resolve the claims brought against Taishan Gypsum Company Ltd., f/k/a Shandong Taihe Dongxin Co. Ltd., and Taian Taishan Plasterboard Co. Ltd. (collectively, “Taishan”) and other Released Parties, including China National Building Material Group Corporation Ltd. and China National Building Material Company, Ltd.; Beijing New Building Materials (Group) Co. Ltd., Beijing New Building Materials Public Limited Company; and (3) the State-Owned Assets Supervision and Administration Commission of the State Council (collectively the “Defendants”).
